These Terms and Conditions of Sale (the “T&Cs”) govern all orders placed on the website www.guavaswim.com, operated by LB ENTREPRISE under the brand name GUAVA.

By validating your order, you fully accept these T&Cs.

ARTICLE 2 – PRODUCTS

The products offered are described and presented with the utmost accuracy.

However, slight variations (colors, reflections, textures) may occur depending on screen settings and devices.

Stock availability is displayed subject to error or delayed updates.

We reserve the right to modify descriptions, prices, colors, or availability at any time.

 

ARTICLE 3 – PRICES

Prices are indicated in euros and may be shown inclusive or exclusive of taxes depending on the delivery country.

They do not include shipping fees, customs duties, or potential import charges.

The price charged is the one displayed at the time of order confirmation.


ARTICLE 4 – ORDERS

To place an order, the customer must:

• select items

• provide personal information

• validate the cart

• accept the T&Cs

• proceed to payment


Order confirmation constitutes proof of the transaction.


GUAVA reserves the right to refuse any order in cases of:

• manifest error

• unavailable stock

• refused payment

• suspected fraud

 

ARTICLE 5 – PAYMENT

Payments are secured via Shopify Payments and/or third-party providers.

Accepted payment methods include:

• credit/debit card

• Apple Pay / Google Pay

• PayPal

The customer guarantees the accuracy of their payment information.


ARTICLE 6 – SHIPPING

Delivery times are estimates only and may vary depending on destination, carrier, and peak periods.

Customs duties, local taxes, or import fees remain the responsibility of the customer for orders shipped outside the European Union.

In accordance with Article L216-4 of the French Consumer Code, the transfer of risk occurs when the customer takes physical possession of the product.

In the event of significant delay or confirmed loss, an investigation will be opened with the carrier.

ARTICLE 7 – RIGHT OF WITHDRAWAL (EUROPEAN UNION & UK)

In accordance with European law, customers residing in the European Union or the United Kingdom have 14 days from receipt of their order to exercise their right of withdrawal.

To be eligible for return, items must strictly meet all of the following conditions:

  • be new, unworn, unwashed, and undamaged
  • have all original tags intact
  • for bikini bottoms: retain the hygiene protection in place (not removed or repositioned)
  • be returned in their original, clean, and intact pouch
  • show no traces of makeup, perfume, cream, perspiration, or residue

Any incomplete, damaged, improperly tried-on item, or any item returned without its original tag, hygiene seal, or packaging will not be accepted.

Return shipping costs are borne by the customer, except in cases of confirmed defective products (see Article 9).

ARTICLE 8 – RETURNS & REFUNDS

Returns must be made within 14 days of receipt.

Acceptance conditions are detailed in Article 7 and in our Return Policy.

 

After receipt and inspection:

• refund to the original payment method

OR

• store credit with no expiration date (customer’s choice)


Initial shipping fees and any customs duties are non-refundable.


In the case of a defective product:

• GUAVA reimburses return shipping costs upon presentation of proof

• inspection is conducted prior to validation

 

ARTICLE 9 – LIABILITY & PRODUCT CARE

GUAVA shall not be held liable for:

  • misuse of the product by the customer
  • indirect damages (loss of opportunity, loss of revenue, etc.)
  • delivery delays attributable to carriers, customs authorities, or external circumstances
  • loss, theft, or damage occurring after the parcel has been handed to the carrier


Certain GUAVA models feature decorative jewelry elements in stainless steel, zamac, and natural stones, carefully selected for their beauty and uniqueness. Although durable, these materials require delicate handling and may be sensitive to shocks, friction, chemicals, or improper care.

Specific care instructions are provided to ensure the longevity of your swimwear. GUAVA cannot be held responsible for deterioration resulting from:

  • failure to follow care instructions
  • prolonged contact with chemicals (sunscreen, perfume, oils, concentrated chlorine, abrasive products, etc.)
  • excessive exposure to salt, sand, or chlorine
  • improper washing or forced drying (washing machine, tumble dryer, radiator, intense sunlight, etc.)
  • excessive friction, snagging, or accidents (impact, drop, or shock affecting stones or jewelry)
  • misuse or non-conforming use

Natural stones may have increased sensitivity to impact; this is inherent to their nature and does not constitute a manufacturing defect.

Normal wear and tear due to time, environment (sea, pool, sun), or usage conditions shall not be considered a defect. Decorative jewelry elements are not functional components of the swimwear and are therefore not guaranteed against damage resulting from use or normal wear.

ARTICLE 10 – LEGAL GUARANTEES

In accordance with French Consumer Law, GUAVA applies:

  • the legal guarantee of conformity
  • the guarantee against hidden defects

Excluded from coverage:

  • natural wear and tear
  • alteration due to salt, chlorine, sand, or sun exposure
  • damage resulting from improper care
  • deterioration of decorative jewelry due to use

ARTICLE 11 – FORCE MAJEURE

GUAVA shall not be held liable for unforeseeable and external events preventing fulfillment of its obligations, including strikes, health crises, transport disruptions, extreme weather, fires, administrative decisions, etc.


ARTICLE 12 – GOVERNING LAW

These T&Cs are governed by French law.

In the event of a dispute, an amicable resolution will be sought first.

Failing amicable resolution, jurisdiction shall be determined in accordance with applicable legal rules.

For consumers residing in the European Union, mandatory consumer protection provisions of their country of residence may apply.


ARTICLE 13 – PERSONAL DATA

Personal information is processed in accordance with our Privacy Policy.


ARTICLE 14 – INTELLECTUAL PROPERTY

All elements of the Website (texts, images, designs, logos, models, jewelry, descriptions) are the exclusive property of GUAVA.

Any reproduction is strictly prohibited.

 

ARTICLE 15 – MODIFICATION OF TERMS

GUAVA may modify these T&Cs at any time.

The applicable T&Cs are those in force at the date of the order.
